Setting aside of an Acquittal Order passed by the Court in Corruption Case

The Supreme Court has held that corruption is an offence against the society. It has made it clear that corruption is an offence against the society. Offences covered under the Prevention of Corruption Act are public in nature. All these observations has been passed by the Supreme Court while exercising its appellate powers and while setting aside the acquittal order passed by the Gujarat High Court.
An Appellate Court while dealing with an appeal against acquittal passed by the learned trial Court, is required to bear in mind that in case of acquittal there is double presumption in favor of the accused. Firstly, the presumption of innocence is available to him under the fundamental principle of criminal jurisprudence that every person shall be presumed to be innocent unless he is proved guilty by a competent court of law. Secondly, the accused having secured his acquittal, the presumption of his innocence is further reinforced, reaffirmed and strengthened by the trial Court. Therefore, while dealing with the cases of acquittal by the trial Court, the Appellate Court would have certain limitations.
