The Right to Vote is one of the fundamental rights of every Indian Citizen. It was observed by the Court that to cast a vote by a lawmaker prior to his conviction order in a criminal charge on the same day can not be termed as invalid. Before his conviction, to hold a disqualified legislator "would grossly violate his substantive right to be treated as innocent until proven guilty ".
