Issue- Whether a degree in Electrical Engineering/Electrical and Electronics Engineering is technically a higher qualification than a diploma in that discipline and, whether degree holders are eligible for appointment to the post of Junior Engineer (Electrical) under the relevant recruitment rules, is the issue that falls for decision in these appeals arising out of a common judgment of the Himachal Pradesh High Court. As is evident, this issue is not novel and has an almost endemic tendency requiring judicial attention, albeit in myriad and diverse contexts.
Held- This clarifies beyond doubt that even for the post of Junior Engineers, those individuals holding higher qualifications are eligible to compete. In the opinion of this Court, though the amending rules were brought into force prospectively, nevertheless, being clarificatory, they apply to the recruitment that is the subject matter of the present controversy. Such a position (i.e. clarificatory amendments operative retroactively, despite their enforcement prospectively) has been held in several previous judgments of this court.
It was state that even for the post of Junior Engineers, the individuals who are holding higher qualifications are eligible to compete. This direction to HPSEB is to be processed for candidature of all applicants, including degree holders who participated, and depending on relative merits, proceed to issue final selection list of all successful candidates, after holding interviews, etc. Therefore, order of High Court that only those with matriculation and holding diploma in relevant subject are considered eligible for post of Junior Engineer set aside
