Section 22 of the Mine & Minerals Act prohibits the Court from taking cognizance of any offence punishable under Mine & Minerals (Development & Regulation Act) or any rules made thereunder except upon complaint in writing made by a person authorized either by the Central Government or State Government. This bar under Section 22 of the above mentioned Act, will not be attracted when the orders to lodge an FIR under Section 156(3) of CRPC have been passed by the Magistrate.
