Interplay between the Designs Act, 2000 & The Commercial Courts Act, 2015.

It is not mandatory that a suit involves the issue of cancelation of design Under Section 22(4) of the Designs Act should be heard by the High Court having a commercial division. The High Court without Original Civil Jurisdiction & a Commercial division is also competent to consider such a case. There is no provision under Commercial Courts Act, 2015 which either prohibits or permits the transfer of the proceedings under the Designs Act to the High Court's which do not have ordinary Original Civil Jurisdiction.Held- It is not mandatory that a suit involves the issue of cancelation of design Under Section 22(4) of the Designs Act should be heard by the High Court having a commercial division.
