Section 138 of the Negotiable Instruments Act.
It was held by the Hon’ble Court that the declaration of moratorium under section 14 of the IBC covers criminal proceedings for dishonoring of cheque under section 138 of the Negotiable Instruments Act against the corporate debtor. The object of moratorium provision is to see that there is no depletion of corporate debtor’s assets during insolvency resolution process so that it can be kept running as going concern during this time, thus maximizing value for all stakeholders. It was further stated that “we hold that a section 138/141 NI Act proceeding against a corporate debtor is covered by section 14(1) (a) of the IBC.
