Section 11(5) & (6) of the Arbitration and Conciliation Act, 1996

There was a dispute between the parties to arbitration agreement, which cannot be left without forum for resolution of dispute by taking a hyper technical view of matter. Therefore, the court has set aside the application of dismissal of application for the appointment of sole Arbitrator. And the Former Chief Justice of High Court of Uttrakhand was appointed as the sole Arbitrator for the settlement of the disputes between the parties.
